Emmanuel Jacubowitz

Lawyer - Public, Constitutionnal and Administrative Law; Health law; (Social) Civil servants law; Mediation Lawyer Xirius

Emmanuel Jacubowitz is specialized in constitutional and administrative law. 

He has practised at the Brussels Bar since 1999. 

He holds a law degree from the Université Libre de Brussels, orientation public law (1998), and a specialized law degree in constitutional law and administrative law from the same institution (1999). He has also been trained in environmental law at the Facultés Universitaires Saint-Louis (1999).

After 12 years working as a lawyer, he understood the importance of mediation and got trained in civil and commercial mediation (PMR Europe, 2011), mediation in complex investments projects (Vlaamse Vereniging voor Begeleiding en Bemiddeling in Complexe Investeringen, 2013), administrative litigation mediation (Katholieke Universiteit Leuven, 2014) and social mediation (PMR Europe, 2017).

As a lawyer, he practises in all branches of constitutional law and administrative law in general. His special attention goes to constitutionnal law, civil servants, health care, nursing homes, regulated professions, regulation authorities and mediation counsel.

In addition to his legal activities, he teaches constitutional law and administrative law, in particular the organisation of the Belgian state, the position of public servants, administrative transparancy and motivation, as well as administrative litigation, at the Federal Agency for the Safety of the Food Chain (AFSCA-FAVV).

He participates regularly in symposiums as a speaker on various questions of constitutional and administrative law, in particular the position of public servants.

The also takes a close interest in issues relating to the conditions of access and performance of surveyor, regarding to which he acts as a speaker at conferences and as an author in articles.

As a lawyer, he advises his clients in all these matters and represents them before the administrative authorities, the upper and lower courts, the Council of State and Constitutional Court, as well as the Court of Justice of the European Union (Luxemburg) and the European Court of Human Rights (Strasbourg).

He also contributes to the review “Public administration”, specialised in constitutional and administrative law, and the Surveyor lawbook.

He is member of the non-profit organisation « Genootschap Advocaten Publiekrecht » (Society of Public law Lawyers).

He is one of the four chairmen of the Deontology Commission for human and animal pharmaceuticals) of the non-profit organisation « Pharma.be ».

He’s also a certified mediator in civil, commercial and social matters, as well as a mediator in administrative matters (no certification exists in these matters).

 

Finaly, he’s a member of the Federal Mediation Commission. 

He practises in Dutch, French and English.
